  1. RATES & CHARGES: Customer understands that rates charged are subject to periodic change. Company will give Customer 30 days prior notice of increases or other changes in its rate structure so that, if Customer wishes, Customer may terminate service prior to implementation of a change in rates for service. Customer also understands that company charges for other items, including, without limitation, relocation of service after initial installation, connecting additional electronic devices and the reconnect, returned check and other charges described in the following paragraphs. Charges for service continue to accrue until the Company is notified to terminate service.
  2. BILLING AND PAYMENT; NON-PAYMENT; LATE CHARGE: Monthly service charges will be billed in advance and are due at Company's business office on the first day of the billing month, and are delinquent l0 days after the due date. In the event that the Customer fails to pay any charges assessed by the due date thereof, the Company will assess a late fee of $5.00. The parties agree that the actual damages sustained by the Company as a result of late payment would be impracticable or extremely difficult to determine, and therefore the foregoing amount is presumed to be a reasonable approximation of the damage sustained by the Company. In addition to the foregoing, the Company may at its sole discretion disconnect service to the Customer without notice. lf service to the Customer is disconnected because of non-payment; service will be reconnected upon payment by Customer of (a) the past due balance, including any late charges, and a standard reconnection fee. Customer shall be responsible for any costs of collection, including reasonable attorney's fees, incurred by the Company in collecting any amounts due by the Customer under this agreement. Further, a service charge of S35.00 will be assessed for any check returned by the bank unpaid.
  3. ACCESS TO PREMISES: Customer hereby grants to Company the right to enter upon and over the premises at the address on the reverse side of this agreement at any time during the term of this agreement to install, connect, disconnect, inspect or alter Company's equipment. Customer understands that the Company may make periodic external inspections of the equipment at any time during normal business hours. Upon prior notice, Company may make periodic inspections of the equipment located within Customer's residential unit, during normal business hours. In the event that Customer is not the owner of the premises in which the equipment is to be installed, Customer warrants to Company that he/she has obtained the consent of the owner of the premises to the Company's installation and maintenance of the equipment as provided in this agreement. In addition, if Customer is not the owner of such premises, Customer agrees to indemnify and hold Company harmless from and against any and all claims of such owner arising out of the performance of this agreement.
  4. SERVICE CHANGES AND INTERRUPTION: Customer further understands that Company uses telephone and power company facilities and public and private rights-of-way in order to provide service, and this continued use cannot be guaranteed. In the event such use or access is denied to Company for any reason, service to Customer may be interrupted or discontinued. lf Company is unable, in its sole discretion, to provide service over alternate routes, Customer agrees not to make a claim against Company for such interruption or termination of service. Company shall have no liability of any nature for any failure or interruption of program transmission or service caused by or resulting from any circumstances beyond its control, including without limitation, acts of God, fire, natural disaster, strike, riot, civil commotion, weather, or decisions by providers of services.
  5. CREDIT CHECKS: You authorize Somoco Wireless to investigate your financial responsibility and creditworthiness, including without limitation, acquiring credit reports and histories, and to report any payment defaults to credit reporting agencies. Such credit checks may require you to provide to Somoco Wireless with your social security number. Under the Fair Credit Reporting Act, you have the right to notify Somoco Wireless if you believe that we have reported inaccurate information about your account to any credit reporting agency. Please include in any such notice the specific item of dispute and why you believe the information reported is in error.
  6. PROMOTIONAL OFFERS: lf you received free equipment or installation as part of a promotional offer and you cancel prior to any applicable expiration of that promotion, you are not entitled to any refund or credit for the unused portions of such discounted price. Lf you received a discounted or free installation/equipment package in exchange for your agreement to remain a subscriber for a specific term you may incur fees for terminating your service before the expiration of the commitment period.
  7. MISCELLANEOUS PROVISIONS: Customer agrees to pay any local, state, or federal taxes imposed with respect to its receipt of internet services or the equipment during the term of this agreement. Customer may not assign this agreement. Any attempt by Customer to assign, sublet, or transfer any of the rights, duties, or obligations of Customer under this agreement is prohibited and void. lf Customer moves to a new residence, Customer must immediately terminate his or her account. Customer is and will remain liable for all services rendered by Company until a request by Customer for termination of the Service is received by the company. This agreement constitutes the entire agreement between Customer and Company for the items and services ordered.
